Preparing For The Possibility Of Bankruptcy

Going to see a bankruptcy attorney? You are probably wondering what you should take with you. This article will give you some insight into the process.

If this is your first visit and you are not even sure if you want to file bankruptcy, then you will need to have some idea of your finances, particularly, what you make and what you owe. If you have a house being foreclosed against or a car which has been repossessed or about to be, then you will need to take all of your documents regarding the debt as well as copies of payments you have made and the underlying mortgage or financing agreement.

At The Attorney’s Office

Be aware that a bankruptcy attorney will give you a questionnaire to take home and complete which will give the attorney the detailed information needed to file your case. So it is not necessary to take a lot of forms and files and things on your first visit. What you want to do on that visit is to determine if bankruptcy is right for you and if it is, whether you should file a Chapter 7 or a Chapter 13. And of course, you want to determine if this is the lawyer you want to represent you.

Choosing The Right Attorney For You

So here are some things to look for in retaining the services of an attorney. How are you greeted when you enter the reception area? Do you have to wait a long time before you see the attorney? Are you directed to a legal assistance or secretary first? This may be okay to get your background information and to complete the initial client interview form. However, if the secretary or legal assistant is assessing your case and then the attorney just repeats what that person concluded, you want to politely take your leave.

Also, do not wait more than 30 minutes past your appointment time for the attorney unless the attorney calls and asks you to because of some unforeseen event. Being delayed in court does not count as that happens quite often and the attorney should do a better job of scheduling appointments. You are already in distress and you really do not deserve nor need additional stress.
