Being Sued For Credit Card Debt
Not All Attorneys Are Experts On Debt
Are you being sued for credit card debt? Then you will want to get an attorney who is competent in debt collection matters. Not every attorney, even if the attorney is a skilled litigator, knows all the subtle issues involved in debt collections. For instant, did the credit card company give you the required notices and disclosures before filing their lawsuit? Is the interest rate too high for your state? Are there other problems with the underlying debt or credit card which might violate federal law?
You need an attorney who understands debt collection and who has a track record of representing people in the same or similar cases. So how do you go about finding such an attorney?
Locations For Finding Legal Help
There are several sources you can tap for help. The most obvious is your local bar association. Typically you will be given the contact information on at least three attorneys and then you will need to set up an appointment to meet with them and to decide which one is right for you and your wallet. Be sure to specify to the bar representative that you need an attorney with expertise in consumer and debt law.
If you doubt your ability to afford an attorney, still go to the initial interview as the attorney may discover that your case is one which has merit and a counter suit can be filed against the credit card company in which the attorney will be able to collect attorney fees. A lot of attorneys will not charge a fee for an initial consultation.
Options Exist For Tight Financial Situations
Another avenue you can travel is to contact your local legal aid society if your city or county has one. This is definitely the resource for you if you do not think you can afford an attorney. Also, some local charities provide limited attorney help in debt collection cases. Another possibility is if there is a local organization of debt attorneys or a womens or minority bar association which usually have attorneys willing to work pro bono (for free) in certain types of cases. Finally, if you are near a law school, then most law schools have a civil law clinic which might be willing to accept your case. Whatever you do, do something. Doing nothing will only hurt you in the long run.
